Scope
These terms and conditions of sale apply to every sale of photographic prints offered on arnaudfonquerne.com, in France and abroad. The customer accepts them by sending an order request.
Ordering
The customer sends a request through the form on each print’s page, giving the chosen format and the delivery address.
The seller confirms by email within 48 hours that the print is available, and sends the total amount, delivery included, with a secure payment link or bank details. The order is firm and final once payment is received.
If the print is no longer available, the customer is told by email and is not charged.
Prints
Prints are made in limited editions; the number of copies is shown on each print’s page. They are described and shown as accurately as possible; on-screen reproductions do not exactly render the colours and the texture of the paper.
Prices
Prices are in euros, all taxes included, excluding delivery. Delivery costs are given to the customer before payment. The price that applies is the one shown when the order request is sent.
Payment
Full payment is made before shipping, by card through the secure payment link (Stripe) sent by the seller, or by bank transfer. The seller never has access to the customer’s card details.
Delivery
The print ships once payment is received, within fifteen (15) working days for mainland France and twenty (20) working days for other countries. It is delivered to the address given by the customer, who makes sure it is correct; a parcel returned because of a wrong address is sent again at the customer’s expense.
On receipt, the customer checks the parcel. If it is damaged, the customer records precise reservations with the carrier and tells the seller by email within three (3) working days, with photos.
If the delivery time is not met, the customer may cancel the sale after asking the seller to deliver within a reasonable time; the customer is then refunded in full within fourteen (14) days at the latest.
Right of withdrawal
The customer has fourteen (14) days from receiving the print to withdraw, without giving a reason, by telling the seller by email or with the form in the appendix. The customer then returns the print, in its original packaging and in perfect condition, within fourteen (14) days of that decision; return costs are paid by the customer.
The seller refunds everything paid, including the initial delivery costs, within fourteen (14) days of being told of the withdrawal. The refund may be held until the print, or proof that it was sent back, is received.
Under article L221-28 of the French Consumer Code, the right of withdrawal does not apply to a print made to the customer’s specifications or clearly personalised (custom size or framing, dedication).
Legal guarantees
The seller is bound by the legal guarantee of conformity (articles L217-3 and following of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code).
Under the guarantee of conformity, the customer has two years from delivery to have the print brought into conformity, by replacement or, failing that, by refund. Under the guarantee against hidden defects, the customer has two years from discovering the defect to cancel the sale or obtain a price reduction.
Any claim is sent to the seller by email.
Intellectual property
Buying a print does not transfer any copyright. The photographs remain the property of Arnaud Fonquerne; the print is for private use and may not be reproduced, distributed or exploited without his written permission.
Personal data
Information given with an order is used only to handle it. How it is processed is described on the Privacy policy page.
Disputes
These terms are governed by French law. In case of dispute, the customer first contacts the seller to find an amicable solution. Failing that, the customer may use a consumer mediator free of charge or the European online dispute resolution platform (ec.europa.eu/consumers/odr), then take the matter to the competent court.
